clippers owner donald sterling fights to keep his team saying it's illegal to force him to sell over his racist comments because he did nothing wrong. from across the bay to around the world, the stories that matter on "kpix 5 news this morning." captions by: caption colorado comments@captioncolorado.com >> good morning, everyone. it's wednesday, may 28. good to have you on board. i'm frank mallicoat. >> i'm michelle griego. time now is 6:00. the families of the santa barbara murders are turning grief in action. i'm cate caugiran with developing news out of the east bay. a shooter kills one and injures another at a gas station. what police are saying about the investigation. >> and getting a check of the roads right now out to the bay bridge once again the metering lights were turned on at 5:33. so that's definitely the earlier side of things. jammed to the 24 interchange. eastshore drive time is okay even though we are starting to

see a few brake lights on our sensors through berkeley and emeryville. that drive time is still 19 minutes from the carquinez bridge to the maze. but it is backing up very quickly out towards the toll plaza. there was also an earlier stall on westbound 80 right before you reach the pay gates. westbound 580 jammed solid as well through grant line straight on through at least north first street. that's where we see our slowest traffic and then kind of picks up a bit kind of sluggish all the way to the dublin. ace 1 is behind by 15 minutes. ace 3 is on time as well as vta and ferries. with the forecast, here's lawrence. looking like a very nice day ahead. we are going to see a lot of sunshine outside. but the winds will be kicking up how about a live shot from

treasure island looking good? red flag warnings through the delta and carquinez strait, dry winds and gusty conditions and dry there so fire danger is high. looking nice out over the bay. clear skies temperatures in the 50s. by the afternoon, cool and breezy at the coastline, warmer inland, temperatures in the 80s, mid-80s into antioch and brentwood and lots of 70s inside the bay. that's a look at weather, guys. back to you. >> thank you, lawrence. developing now over in vallejo the search is on for the person who shot and killed a man at a gas station in the east bay. kpix 5's cate caugiran reports. >> reporter: vallejo police believe that the car that one of the victims was in was

targeted. it's cleared now but here's the scene earlier. several evidence markers indicate that this will be an extensive investigation. the shooting happened around 9:00 last night at this "five star" station on lincoln road west. investigators say a suspect fired several shots at a car in the parking lot. inside, a 24-year-old man, he later died after being taken to a nearby hospital. >> it's very early in the investigation. we don't know what the motives are or the cause of this shooting is. we have two shooting victims t. >> reporter: there was a second person nearby who was also hit by a bullet but police say that person is expected to survive. it is unknown at this time if the victims knew each other or what the relationship was to the shooter. so far no one has been arrested. live in vallejo, cate caugiran, kpix 5. >> and police have not released the names of the two victims. it was a day to remember the victims of the rampage in isla vista. 20,000 gathered at uc-santa

barbara for a memorial service. kpix 5's kiet do is in san jose where one of the students who was killed went to school. >> reporter: good morning. the victims' families including george chen's from right here in south san jose are taking this opportunity to try to prevent more gun violence. yesterday's memorial filled the stadium to capacity as they remembered the 6 victims murdered during that 10-minute killing spree from over the weekend. more than 20,000 people chanted, not one more. richard martinez's son chris was shot dead in a deli that night and is asking for more gun control. >> that's why chris and these other kids died. it's unbelievable that we're at this point. too many people have died. and there -- it should be not one more. >> we would die 100 times, 1,000 times but we don't want our kids get hurt. it shouldn't happen to anybody, this should be the last one in

the united states. >> should take steps to stop it. it shouldn't happen. >> reporter: those last two people were the parents of george clen who visited a makeshift memorial in isla vista. rodger's first victims were three south bay students, david wang, james hong and george chen. they were smart hard working students with chinese backgrounds in college. two california lawmakers were proposing a gun violence restraining order where friends, family or partners can call police if they suspect someone of committing violence. live in south san jose, kiet do, kpix 5. >> stay with kpix 5 and kpix.com for continuing coverage on air and online. new developments in the battle between donald sterling and the national basketball association. as cbs news' marlie hall reports, sterling says the league has no legal grounds to terminate his ownership of the

los angeles clippers. >> reporter: donald sterling says the nba has no right to take away his team. in a 32-page response to the league, the l.a. clippers owner called the nba's efforts to force him to sell the franchise illegal. the document from sterling's lawyer said, putting it most simply stripping mr. sterling of his ownership because of a private lovers quarrel that was not intended to harm the nba or even become public is an outrageous punishment. the nba banned sterling for life and fined him $2.5 million after his statements to former girlfriend stiviano were leaked. >> you wanted to broadcast that you're associating with black people. >> reporter: the nba charged sterling with damaging the league and his business partners with his racist remarks. but sterling argues those comments were illegally recorded during a lovers'

quarrel and were never meant to be made public. the league said in a statement on tuesday night that it had received sterling's response and its board of governors will vote next week on whether to terminate his steak in the clippers and force sterling to sell. marlie hall kpix 5. >> an attorney for sterling's wife shelly has confirmed her husband has given her written permission to sell the team. advocates for renters have created a crowd sourcing map for people going through -- for people going through eviction. in a story you'll only see here on kpix 5, we have discovered it's especially a big problem in of where the rent board is swamped. it's trying to handle a record number of cases over the past year mostly dealing with evictions and skyrocketing rents. >> so if you walked in today you wouldn't get a hearing for

many months. that's not acceptable to me. >> executive director wilkes says there are nearly 600 folders with cases all to be handled and heard but the department's staff can only hear 80 cases a month. two students taking legal action against a school, a city and county over a clash with the campus police. they said they were injured in march and were left with emotional and physical scars. they want the school to apologize for saying they investigated the violence they also want their medical bills paid. a tribute to harvey milk is happening today at san francisco city hall. a dedication ceremony for the new forever stamp featuring his photograph is planned this afternoon. mayor lee and milk's nephew will expected to attend. the stamp was unveiled at the white house last thursday on his 84th birthday. the stamp is already on sale. the fight between chili sauce maker sriracha and a los

angeles suburb is cooling off. people living near the sriracha plan in irwindale complained that spicy odors burned their throats and eyes. the city council filed a public nuisance lawsuit. it looks like the suit will be dropped after pressure from the mayor and governor brown's office. sriracha has taken steps to reduce the odor. several cities and states have been openly courting the factory to relocate. time now is 6:09. people around the bay area have been cashing in as a mystery millionaire leaves twitter followers -- leads twitter followers on a scavenger hunt for money. >> reporter: good morning from treasure island where we're talking hurricane season. the latest on amanda with mobile weather. >> the winds kicking up around the bay area today. the sea breeze is blowing. red flag warnings with up. >> we're only at 6:09 in the morning already backed up through the macarthur maze. metering lights are on once again. tell you how bad the commute is there plus the rest of the bay area all coming up. but first, we want to know what

concord into walnut creek. here's a live look at the bay bridge. check out the tweet from "kcbs traffic." the metering lights were turned on early once again. 5:43. so we're not sure what's going on but the last couple of weeks they have been turning on the metering lights at 5:45. it's already backed up through the macarthur maze. usually they are turned off closer to 6:00. backed up through 24. so just prepare for that. there was a stall approaching the ba -- there was a stall approaching the bay bridge toll plaza. there was overnight roadwork that was a little delayed getting picked up, everything is clear now so we are not seeing any delay from san leandro into oakland and southbound 880 looks great as well as as you pass the coliseum, oakland airport. you just missed the lanes change crews. they just drove past 2 lanes open northbound 4 lanes open in the commute direction

southbound heading into san francisco on the doyle drive approach. everything looks great though from san rafael into san francisco. and to the south bay now northbound 101 a little bit of slowdowns as you approach the alum rock exit. you can see it there northbound and southbound 101 sluggish but 280 guadalupe parkway, 85, everything else showing green. so we'll put up some travel times for you and you can see it's your usual commute right there. mass transit ace train number one got off to a rough start out of stocked. there was an earlier fire near the tracks. they had to hold ace train 1 for about 15 minutes while they put the fire out. everything is resolved but train 1 is still late by 15 minutes. ace train 3 is on time. remember kcbs when you hit the roads at 106.9 fm or 740-am. with the forecast, here's lawrence. that breeze is blowing around the bay area again this morning. so far just a gentle breeze early on but by the afternoon, likely going to see those winds picking up outside and kind of a blustery day toward the

coastline and into the delta. looks like we have mostly clear skies right now if you are headed out the door. not a bad start to the day. looks like by the afternoon, plenty of sunshine. the temperatures going to be slightly warmer especially inland but still breezy. and then a cool fog going to make a return as we head in toward friday and the weekend with some much cooler temperatures expected. now with those winds blowing outside we have some red flag warnings posted in the carquinez strait through the delta. the winds expected to 20 miles per hour gusting to 30 or so. and the humidity is running very low less than 10% so red flag warnings through thursday. high pressure sliding east now, the low dropping in out of the gulf of alaska that will bring in cooler air to the bay area. still the temperatures not bad 70s and 80s down to the south bay, 60s and breeze breeze toward the coastline. inside the bay, you will find those temperatures fairly mild. and even some mid-80s inland toward brentwood and antioch then into the delta cooler 73 richmond 82 in the napa valley, about 69 in san francisco. your sunrise time is at 5:51.

here on the pacific side, hurricane began on may 15. boy, do we have us a hurricane. let's talk about it. its name is amanda. over the weekend, there in manzanillo, mexico, we saw so much storm, not a direct hit from a hurricane but a glancing blow. hurricane offshore about 600 miles just off the coast of the tip of baja. amanda was the strongest hurricane on record in the month of may as its winds peaked at 155 miles per hour. the strongest hurricane ever in the eastern pacific in the month of may. let's look at where it's located now just about 600 miles off the coast of the tip of baja. and it continues to wobble along out of the northeast at 2 miles per hour. it's lost strength. it was a category 5 hurricane at one time. just in case you're keeping track of such matters, we have

this police investigation. >> president obama outlines a plan to end the 13-year conflict in afghanistan. the thousands of troops will remain in the country after the war's end. >> winds are back. looks like the red flag warnings and high fire danger going up, too. we'll talk about that coming up. >> and another busy commute this morning over at the bay bridge toll plaza. backed up on all the approaches into the macarthur maze approaching the pay gates. full look at your drive to work coming up. >> thank you. good morning. it's wednesday may 28. i'm frank mallicoat. >> i'm michelle griego. time now is 6:31. mourners across the state of california gathered to remember the lives lost in that deadly isla vista rampage. kpix 5's kit it live in san jose. and kiet, three of those students from right here in the bay area. >> reporter: yeah. one of those students george- cent graduated from this high school two years ago. folks showing up from santa barbara all the way to the south bay to mourn those lost in that rampage over the weekend trying to push for

change. at a memorial service to honor the sick victim murdered, there was grief, tears and a call for change. >> not one more. >> reporter: richard martinez's son chris was shot dead in the deli that night. he asked a crowd in santa barbara to put pressure on politicians to take steps to limit guns. >> that's why chris and these other kids died. it's unbelievable that we're at this point. too many people have died. and there shouldn't be -- it should be not one more. >> reporter: elliott rodger's first victims were three south bay students. david wang, james hong and george chen. george's parents visited a makeshift memorial in isla vista. >> we would die 100 times, 1,000 times we don't want our kids get hurt it's just shouldn't happen to any family, this should be the last one in the united states. >> should take the necessary steps to stop it. it shouldn't happen. >> reporter: the three victims had a lot in common, smart,

hard working students with chinese backgrounds pursuing engineering or computer science degrees. and a bill has been introduced in sacramento that would create a gun violence restraining order. that's a system where people can report someone who might be committing some kind of violence in the near future to call 911 and report that to police. live in south san jose, kiet do, kpix 5. >> tonight a candlelight vigil to honor the victims will be held at the uc-berkeley campus at its memorial glade. in his manifesto the isla vista killer rodger described a rage that intensified over several years. he talks about splashing coffee on two couples he saw kissing because he was jealous. in 2012 he dropped out of college because he didn't want to see, quote, beautiful girls he couldn't have. he grew obsessed with winning the lottery and threw tantrums if he didn't win. and last summer rodger tried to

push some girls off a 10-foot ledge at a party but he fell instead and broke his leg. for more, stay with us on air and online. 6:34. lawrence's turn to chime in now. a little sun and breezy too, i guess. >> reporter: red flag warnings into the delta, the carquinez strait. a lot of sunshine outside. but getting breezy in spots along the coastline through some of the mountain gaps and the deltta . out the door we go. nice shot as we look toward the rock this morning. clear skies, beautiful conditions out there. you can see the waters blowing just a little bit out on the bay right now. so we are going to get the idea of a sea breeze kicking in and we are going to see more winds blowing and maybe some whitecaps toward the coastline. with that in mind, we have a cold front swinging through falling apart as it moves by so not much left behind. lots of sunshine right now and temperatures in the 50s outside. this afternoon sunny at the coastline, breezy at the

beaches. 70s inside the bay. maybe mid-80s inland. let's check the roads with elizabeth. thank you, lawrence. i mention that macarthur maze delays. the delays on westbound 580 are still pretty bad heading to the bay bridge toll plaza. the metering lights were turned on about 45 minutes ago. even a little bit more than that. so you can see 19 miles per hour now on those westbound lanes. and here's actually a live look. you can see some of the delays now on the westbound approach jammed beyond the 24 interchange and the eastshore freeway also seeing delays now. the drive time there is at the bottom of your screen about 27 minutes on westbound 80 from the carquinez bridge to the maze. we really start to see the brake lights once you hit richmond and again they turned the metering lights on at 5:43 this morning so it's backed up into the maze for a while. mass transit back on track. it looks like ace train 3 no delay. vta also back on time and bart systemwide no delay. that's your latest "kcbs traffic." frank, michelle, back to you guys. >> thank you. we have just learned some

sad news. legendary poet dr. maya angelou has died. among her many accomplishments, the author, poet and civil rights pioneer was awarded the presidential medal of freedom in 2011. dr. angelou was 86 years old. developing right now, the search is on for the person who shot and killed a man at a gas station in the east bay and injured another. kpix 5's cate caugiran is live in vallejo. looks like the shooter targeted one of the victims. >> reporter: yes, michelle. police believe this was the a targeted -- police believe this was a targeted incident. no arrests yet. here's the scene after the shooting. at least 50 evidence markers all over the "five star" station in vallejo. the shooting happened at around 9:00 last night at the gas station. police say the suspect fired multiple shots at a car in the parking lot killing the 24-year- old man inside. now investigators are working

end of the year 2016. >> we will no longer patrol afghan cities or towns, mountains or valleys. that is a task for the afghan people. we have to recognize afghanistan will not be a perfect place. and it is not america's responsibility to make it one. the future of afghanistan must be decided by afghans. >> by the end of this year the current u.s. force of 32,800 will fall to 9,800 and cut in half by the end of 2015 and reduced to just troops to staff the embassy by the end of 2016. two americans were injured when their official u.s. consulate vehicle was attacked in western afghanistan. the injuries are not considered life-threatening. last week two gunmen were killed when they tried to attack the indian consulate there. happening today, vice president joe biden wraps up a visit to colorado and flies to san francisco. biden is scheduled for two private fundraisers this afternoon.

the first is at the home of billionaire tom stier. the other is at the fairmont. biden was in denver yesterday for another fundraiser and to push for immigration reform. in sacramento today, the state senate is expected to vote on a bill that would give the public access to a public beach. at issue is martins beach in san mateo county. sun microsystems cofounder vinod khosla owns property that includes a road which provides the only land access to the beach. he legally belonged the road with a locked gate. the bill by state senator jerry hill would ensure the public has access to the road again. the gold rush is not over yet. the buried treasure found in a california backyard. next. >> and the market opened up a few minutes ago. and we are out of the gate not so great. down nearly 30 points. but lots of time. we'll crunch the numbers and all things business with kcbs radio's financial reporter jason brooks coming up next. >> and we want to invite all you pet lovers out there send us your questions about their

around the bay area today a whole lot of sunshine even at the coastline. it will be breezy but not as much wind inside the bay, temperatures in the 70s and 80s toward morgan hill and gillibrand this afternoon. but in the east bay, those temperatures a little warmer

maybe some mid-80s in toward antioch and brentwood. 81 danville. 70s and 80s toward morgan hill and gilroy. 79 degrees at clearlake. 81 santa rosa. there's word this morning that youtube may be getting some competition from yahoo. >> reporter: that report coming from adage saying that yahoo is looking to launch a rival site to youtube this summer and it's in heavy discussions with video producers and that is the key, getting that content from the video producers. yahoo hoping to lure the producers from youtube over to their side by offering more favorable advertising splits with the company compared to what youtube currently charges

although it is also reported that youtube currently gives those producers much higher ad rates than what is the average on youtube. so it could be a big site going forward on that account. also reported this morning by the "new york post" that apple will announce an acquisition of a company for less than originally reported. 6:48. a check of traffic. here's liz. >> reporter: sky 1 ron cervi just flew over westbound 580 and says the backups are big here at the livermore valley. you can see why, the red sensors. the dublin interchange extend to mountain house and he tells us the worst of the delays right now are until at least airway. anyway, you can see the speed sensors show those speed limits or the speed sensors are showing just under 25 miles per hour. here's a live look outside. once you hit the san mateo bridge, everything is moving okay along the flat section. it's behind it, westbound 92 on the approach to hesperion there are some delays. so the drive time is 17 minutes between hayward and foster city. and up and over the high-rise to hayward to the east bay everything is great on eastbound 92. checking the roads through downtown san jose, northbound 280 a little sluggish once you get past the guadalupe parkway. and northbound 101 starting to get heavy as well past capitol expressway to alum rock and

past it. so the drive time is 14 minutes between 280 and 237. guadalupe parkway also begins to slow but again, even though we're seeing a few taps of the brake lights right there by 87, it's still in the clear, the drive times, 13 minutes as you pass 101 out to cupertino. and the bay bridge they turned the metering lights on early once again so just a heads up heading into san francisco. you are stacked up fully on all your approaches. that is your latest "kcbs traffic." it's a little breezy, a little sunny. here's lawrence with your forecast. >> should be a nice day ahead. we have a whole lot of sunshine even at the coastline as a weak weather system comes in. we have seen the marine layer dissipate so lots of clear skies even at the beaches. we'll have that throughout the day. the winds will be kicking up. it will be another breezy day outside maybe not quite as windy as yesterday but then that cool fog returning friday and the weekend with cooler temperatures. with the winds outside, red flag warnings have now been posted through the carquinez strait and the delta into the

central valley. fire danger going to be running high there through tomorrow with humidity down to less than 10% and high winds. dangerous fire conditions there. high pressure sliding eastward low dropping in along the kes coast ushering in some of the breezy conditions. temperatures not bad. we'll see a lot of 70s and 80s into the south bay, maybe a little bit warmer than yesterday by just a tad. 60s along the coastline. maybe some mid-80s in the warmest spots well inland. 79 degrees and breezy into vallejo. about 74 in oakland. 69 in san francisco. and 63 in daly city. looking out over the next couple of days, maybe warming up just a degree or two through tomorrow. and then on friday, another low pressure system drops into the bay area. that one is likely to deepen the marine layer bringing more low clouds and fog and some drizzle possibly on friday to the coastline with some much cooler temperatures over the weekend.

people chanting not one more. richard martinez's son chris was shot death last night. he asked the crowd in santa barbara to put pressure on politicians to take steps to limit guns. >> that's why chris and these other kids died. it's unbelievable that we're at this mount. too many people have died. >> we don't want our kids to get hurt.
